Collection of Development Fee Unlawful In Delta State – Bureau Chief

…Law breakers risks two years jail term, advises community leaders to ensure compliance

The Delta State Law which criminalized the collection of any form of development levies or fees at construction sites, either by members of community development committee, association or community leaders is still in force.

Director General of Delta State Orientation and Communications Bureau, Dr (Barr) Fred Latimore Oghenesivbe, in a statement on Saturday, emphasized the need for community leaders and residents in the state to obey the subsisting law cited as the “Public and Private Properties Protection Law, 2018.”

He disclosed that series of complaints lodged with the Bureau, coupled with allegations of acute exploitations trending on social media platforms, revealed that some members of Community Development Association or local Committees constituted by either community leaders or traditional institutions are going about terrorizing private property developers.

Some of the complaints, according to the Bureau’s Director General, include; the use of brute force and coercive strategies to collect all kinds of levies and fees ranging from N200,000 to over N1,000,000 depending on the location and size of building structure indicated in the building plan or project design.

Oghenesivbe further stated that the State Governor, Rt Hon Sheriff Oborevwori, presided over the passage of the Bill as Speaker of the Delta State House of Assembly, as he then was, and subsequently signed into Law in 2018 by the immediate past governor, Senator Dr Ifeanyi Arthur Okowa, CON., adding that those who willfully, deliberately and unknowingly violates the law shall be prosecuted, and such individual or group of persons risks two years or five years jail term upon conviction.

He further stated that governor Oborevwori in an earlier interview with BBC correspondent in 2023, clearly stated that collection of any form of “Deve” in Delta State had been outlawed, and that no individual, community leader or traditional institution is permitted to collect development levies or fees from land developers, either public or private sector.

Oghenesivbe assured that governor Oborevwori will continue to work round the clock to provide mega infrastructure across the three senatorial districts, attract local and foreign investors, while appealing to community leaders and stakeholders not to discourage them from bringing development to their communities, towns and villages through illegal and unscrupulous transactions, collection of levies and fees already prohibited by Law.

“The Public and Private property Protection Law 2018, and more particularly at Section 13(1) and (2) which unequivocally protected property developers from being exploited, and went on to prescribe 2 years imprisonment or N1million fine or both for violators and law breakers.

“Similarly, section 11(1)(a-c) and 2(a)&(b) equally prohibits anybody from selling landed property to more than one person, with or without legitimate title, and violators risks 5 years imprisonment upon conviction.

“Collection of all forms of levies, and fees at all construction sites in all 25 local government areas which includes; communities, towns and villages, is prohibited by law, be it 10% from sale of land in form of development (Deve) fee or levy.

“Forceful entry, assault on construction workers/land owner, or trespassing construction sites without lawful authorization by the site or building owner is illegal, against laws in force, and must be avoided.

“Unlawful collection of foundation digging fee, building materials and other unscrupulous act or conduct by members of community development committee or association should be stopped forthwith to avoid running against subsisting state laws in force, the statement added.

Projects Inspection: Oborevwori’s Oversight Functions To Deliver Quality Infrastructure – Oghenesivbe

Director General of Delta State Orientation and Communications Bureau, Dr Fred Latimore has said that the state governor, Rt Hon Sheriff Oborevwori, is determined to deliver quality infrastructure.

He gave the assurance on Thursday in Asaba, while speaking at a public affairs radio program, pointing out that regular inspection of ongoing road infrastructure projects is an integral part of the governor’s core oversight functions, to ensure that contractors and engineers are on the same page with the state government.

Oghenesivbe assured that site engineers who dare to compromise with contractors to deliver substandard jobs will have issues to grind with governor Oborevwori, while advising contractors to ensure they do the right thing to avoid repudiation of contracts, refund of tax payers money, and/or litigations.

The Bureau Director General further stated that substandard jobs are not only a waste of public money, but also an indictment on both the contractor and the government, which is why governor Oborevwori, will never commission any project that is substandard, as can be seen from the Isheagu-Ewulu 9.1 Kilometer road project wherein he ordered the contractor to return to site.

He disclosed that the road was awarded to the contractor by the previous administration, and that it’s very unfortunate that the contractor faulted in some ways, while commending the Okowa administration for awarding the contract because of the economic value and importance for the communities, and the state government.

Oghenesivbe assured that governor Oborevwori is determined to complete the Isheagu-Ewulu road project in good time. He commended the Commissioners for Works, Urban and Rural, Comrade Reuben Izeze, and Charles Aniagwu, for their valuable efforts and positive steps taken to ensure that ongoing projects are delivered without any form of compromise.

“Governor Oborevwori has demonstrated capacity and willingness to deliver quality projects across the state.

“The recent Isheagu-Ewulu road, wherein he ordered the contractor to return to site to do the right thing, is commendable. It speaks of a patriotic and well focused technocrat and leader who is always ready to ensure that every infrastructure project is worth the tax payers money.

“The body language of the governor speaks volume. Contractors and site engineers must of a necessity brace up, because our governor is not ready to settle for less. He respects contractual obligations devoid of compromise and substandard jobs.

“Regular inspection of projects will continue, it’s part of the oversight functions of governor Oborevwori, to ensure that both the contractors and engineers are on the same page with the state government, as far as standard job delivery is concerned, under meaningful development mantra encapsulated in the MORE agenda.

“The governor has substantial wealth of experience in construction matters, he played inestimable roles during the construction of Osubi Airport and others, and can neither be brainwashed nor manipulated by any contractor or site engineer.

“My sincere and humble advise to contractors and engineers is for them to do the right thing, not to cut corners, never compromise to deliver substandard jobs to avoid public embarrassment and sanctions,” Oghenesivbe said.

DSCRIC To Constitute 4 Critical Committees To Effectively Implement Child Protection Policy of Government

By Patrick Ochei

The Delta State Child Rights Implementation Committee (DSCRIC) in its meeting of 3rd September, 2024, has decided to constitute four critical committees – Advocacy, Education, Health and Support Services Committees to effectively implement the Delta State Child Rights law of 2008 and of course, the Child Protection Policy of Governor Sheriff Oborevwori.

At the meeting presided over by the Chairman and Permanent Secretary of Women Affairs Ministry, Mrs. Oghenekevwe Agas, she said the Committee had come to the threshold of driving down the essence of the Child Rights law to the grassroots having efficiently inaugurated most of the Local Government Child Rights Implementation Committees.

Agas implored all the members present, including the Heads of Personnel Management of various LGAs to brace up to the challenges of resistance and unwilling witnesses in the fight against child abuse and prosecution of offenders.

As part of the way forward, the Committee had benchmarked certain child abuse cases, orchestrated by poverty for evaluation and support. One of such cases came from the report of Barr. Awele Ideal representing FIDA and Comrade Patrick Ochei representing NUJ, to enjoy Government’s support during the celebration of the 16 days activism against gender based violence, for which the concerned woman and her seven years old niece would be reached for financial empowerment, to enable her fend for her family and support the girl’s education.

Agas equally said that other parents or guardians of vulnerable children would be supported to lift up some burdens off them in order to prevent the children in their care from sliding into conflict with the law or being abused as a result of poverty.

Meanwhile, several child abuse cases ranging from child prostitution, defilement, child labour, etc were reported by field officers, for which the Committee had decided to continue to pursue until justice is served.

However, Mrs. Agas posited that even though the Child Rights law of 2008 is being reviewed for amendment at the House of Assembly, the law still remains indifferent to those who intentionally obstruct or pervert justice in child abuse related cases.

She assured that those parents, guardians or stakeholders who usually stand in the way of justice can still be prosecuted and punished, while also maintaining that the operations and actions of the Committee must be in the best interest of the child.

Take Each Day of Your Life As Your Last Day – Ada Anioma

By Patrick Ochei

Ada Anioma, immediate past Delta State Commissioner for Technical Education, Hon. Joan Onyemaechi has charged individuals to take each day of their lives as their last day, insisting that nobody on earth has the power to control what happens to him or her except God says otherwise.

She made this assertion while testifying to the goodness and mercy of God over her safe return after 10 days of captivity in the kidnappers’ den.

Ada Anioma during her thanksgiving celebration at the Mountain of Fire Ministries, Asaba on Sunday 1st of September, 2024, declared that those who kidnapped her were not the wicked ones in her case but those who trade in peddling fake news against innocent persons doing their jobs or fulfilling their destinies.

According to the daring politician who at a point broke down emotionally, “I wish to humbly and respectfully appreciate God for seeing me through the travails of being kidnapped. I also thank those of you from all walks of life who have come to identify with me. My sermon today is that we must take each day of our lives as our last day. This is because, it could be your last. In the past, I used to say God forbid on hearing this kind of sermon.

“Before the unfortunate incident, I was at a church where I had gone to minister, and I was led to take up a prayer point against funeral procession heading towards my home. I didn’t know I was praying for myself, even though I was challenging women with that prayer point.

“The Tuesday before the Tuesday service that I was kidnapped, I was literarily weeping in my spirit. I didn’t know why I was weeping. And on that fateful day too, I woke up that morning with a song in my heart ‘I have a very big God, A very big God o, He no dey fall my hand, He’s always by my side, a very big God’. It was later that day that the song made sense to me.

“In that boat when I was being ferried to an unknown destination, I heard Him clearly again, saying ‘I am by your side, I told you earlier I would be with you’. I could have died of a heartache, but as soon as He spoke to me, I said GOD, give me wisdom and courage.

“I want to say that I am here today by the mercies of God. I don’t know why but He said, I will show mercy to whom I will show mercy. He gave me a second chance to life.

“Why praying that He should deliver me, He said, change it to deliver us. Those who did the kidnapping didn’t know me from Adams, neither do I know them; they were just business people working on information. Those who kidnapped me are not the wicked ones but those who are engaged in selling others to the public market. We must mind what we say about other people. This is because the information you give may not be the right one but an agenda to destroy the person’s hard-work”, Ada Anioma narrated.

Meanwhile, at the point of relaying what transpired before she was abducted, Ada Anioma broke down and wept. She wept at the mention of the names of her two aides who were murdered in a bid to take her – an Inspector of Police, Adamu and a pilot driver, Isaac respectively.

She said Adamu, a native of Sokoto State had two wives and six children, who are now without a husband and a father, while Isaac had a father and a brother who was in the Thanksgiving service. I may have been spared by the mercies of God, but we may need to ask who killed Isaac and Adamu? These people didn’t do anything, but they fell as a result of the information sold out about me to business men who had set up their businesses either for the right or the wrong motives.

In addition to her testimony, the Delta State Government, represented by the Deputy Governor, Sir Monday Onyeme congratulated Ada Anioma for her freedom, thanking God for sparing her precious life for the State and society in particular.

He said, “We join Ada Anioma on behalf of the people of Delta State to give thanks to God. The level of insecurity in different parts of the country calls for concern. We are by this medium calling on Federal Government to arrest the situation.

“Delta is relatively peaceful. We will continue to rely on God for a peaceful and secure State. We celebrate and congratulate Ada Anioma for her safe return”, Onyeme said.

It was a State Thanksgiving as the who-in-who in government, traditional institutions, different religious bodies, persons with disabilities and orphanages were present to worship God with Ada Anioma in thanksgiving.
